3. Principles

The Service Provider provides its services lawfully, fairly and in a transparent manner. The Service Provider respects the fundamental rights and freedoms of Users.

4. The Website and the quote request

4.1. Content of the Website

The Service Provider makes the Website available to everyone, free of charge and without registration. The Website presents the Service Provider’s services, working method, References and team. The content published on the Website — including the description of the services, the presentation of the working process and the References — is for information only and does not constitute an offer within the meaning of Section 6:64 of the Civil Code. Nothing can be purchased on the Website; viewing the Website and submitting a Quote Request give rise to no payment obligation.

4.2. Quote Request

A User may request a quote for the Services through the form available on the Website or at the email address given in Section 1. On the form the Requester provides their name, email address, the project type, the intended deadline, the answer regarding an existing website and the project description, and — at their option — the company name and the address of the existing website. Submission of the form is conditional on the Requester confirming, by means of a checkbox that is not pre-ticked, that they have taken note of the Privacy Policy.

After the form is submitted, the Service Provider sends an automatic confirmation to the Requester’s email address. The confirmation only attests that the Quote Request has been received; neither the Quote Request nor the confirmation creates a contract or binds either party.

The Requester is responsible for the truth and accuracy of the data provided. The Service Provider is entitled to request further information in order to clarify the Quote Request, and is entitled — without giving reasons — to refrain from making a Quote; it informs the Requester accordingly.

The Service Provider normally responds to a Quote Request within 2 working days. Failure to respond within this period has no legal consequence.

In order to prevent abusive use of the Website and of the quote form, the Service Provider limits the number of Quote Requests that may be sent from one visitor address and in total within a given period, and rejects automated submissions; the details of these limits are set out in the Privacy Policy.

4.3. The Quote

The Service Provider makes the Quote in writing, by email. The Quote sets out in particular the subject and scope of the Services, the planned schedule of performance, the fee and its due date, and the period of validity of the Quote. Unless stated otherwise, fees in the Quote are expressed in Hungarian forint or in euro; the Quote states clearly whether the fee includes value added tax.

The Quote binds the Service Provider for the period of validity stated in it. On expiry of that period without acceptance, the Quote lapses. The Quote may be accepted only with the content set out in it; an acceptance that deviates from the Quote qualifies as a new quote request.

4.4. The Individual Contract

The Services are provided under an Individual Contract concluded in writing between the Service Provider and the Client following acceptance of the Quote. The Individual Contract governs in particular the definition of the task, the deadline and schedule of performance, the fee and payment terms, acceptance, the Client’s duty to cooperate, defect correction, warranty, liability, confidentiality, and the rights of use in the work produced. Where the Individual Contract deviates from the GTC, the provisions of the Individual Contract prevail.

The Service Provider provides the Services with the support of tools based on artificial intelligence, but in every case with human decision-making, code review and testing. The Service Provider ensures a tested, reviewed development process that applies security considerations; it does not warrant that the software is free of defects. The handling of defects, warranty and any guarantee are governed by the provisions of the Individual Contract.

4.5. Provisions applicable to a Consumer Client

Where the Client is a Consumer, the Service Provider provides, before the conclusion of the Individual Contract and as part of it, the information required by Hungarian Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, including the information on the right of withdrawal and the model withdrawal form. The Quote Request and the Quote in themselves create no obligation for the Consumer.

4.6. Contact

Visitors to the Website may contact the Service Provider electronically at the email address given on the Website. The Service Provider normally responds to enquiries within 2 working days; failure to respond within this period has no legal consequence.

5. Complaints and enforcement of rights

A User may lodge a complaint concerning the Service Provider’s services and the Website via the contact details given in Section 1 of the GTC, or by post at the Service Provider’s registered office. In handling consumer complaints, the Service Provider acts in accordance with Hungarian Act CLV of 1997 on Consumer Protection (hereinafter: “Consumer Protection Act”). A User who is a sole trader qualifies as a consumer under the Consumer Protection Act only where they act for purposes outside their self-employment and economic activity.

The Service Provider investigates a written complaint within thirty days of its receipt, responds to it substantively, and ensures that the response reaches the User. Where the Service Provider rejects the complaint, it gives reasons for its position. The Service Provider retains the record of the complaint and a copy of the response for five years.

If a consumer dispute between the Service Provider and a Consumer is not settled through negotiation with the Service Provider, the Consumer may avail themselves of the following remedies:

Complaint to the consumer protection authority. If the Consumer perceives an infringement of their consumer rights, they are entitled to lodge a complaint with the consumer protection authority competent for their place of residence (the county or Budapest government office). Following the assessment of the complaint, the authority decides whether to conduct consumer protection proceedings. The list and contact details of the competent authorities are available at https://fogyasztovedelem.kormany.hu.

Conciliation board. For the out-of-court settlement of a consumer dispute concerning the quality of the service or the conclusion and performance of the contract, the Consumer may initiate proceedings before the conciliation board competent for their place of residence or stay, or may apply to the conciliation board competent for the Service Provider’s registered office.

The conciliation board competent for the Service Provider’s registered office:

Budapest Conciliation Board (Budapesti Békéltető Testület) Address: 1016 Budapest, Krisztina krt. 99. I. em. 111., Hungary Postal address: 1253 Budapest, Pf. 10. Telephone: +36 1 488 2131 Email: bekelteto.testulet@bkik.hu Website: https://bekeltet.bkik.hu

Depending on the Consumer’s place of residence (or stay), another conciliation board may also be competent. The contact details of the conciliation boards: https://mkik.hu/a-bekelteto-testuletek-teruleti-honlapjai. The contact details of the boards and the identity of their chairpersons may change from time to time; current contact details should be verified on the board’s website. The Service Provider is under a duty to cooperate in conciliation proceedings; for the purposes of this clause, the submission of a written reply also constitutes cooperation.

A Consumer resident in another Member State of the European Union may, for the settlement of a cross-border consumer dispute, also apply to the alternative dispute resolution body of their own Member State and to the European Consumer Centres Network (ECC-Net; in Hungary: Európai Fogyasztói Központ, https://magyarefk.hu).

Court proceedings. The User is entitled to enforce a claim arising from the dispute before a court in accordance with the Civil Code and Hungarian Act CXXX of 2016 on the Code of Civil Procedure.

6. Liability

Users use the Website and the facilities the Service Provider makes available through it (including the Quote Request and contact) solely at their own risk, and accept that the Service Provider — except for liability for breach of contract caused intentionally or by gross negligence, or resulting in harm to life, physical integrity or health — is not liable for pecuniary or non-pecuniary damage arising from the use of the Website. The Service Provider is further not liable for any loss of service resulting from the quality, failure or interruption of the User’s internet connection.

Use of the Website is free of charge. The Service Provider has no warranty or compensation obligation for the content, operation and availability of the Website, except for damage caused intentionally or by gross negligence. The Service Provider is entitled to modify the Website at any time, to discontinue parts of it, and to suspend its operation.

The References published on the Website present the Service Provider’s previous work. The websites and applications named in the References are owned and operated by the respective clients; the Service Provider accepts no responsibility for their content, operation or data processing practices. The References do not mean that the Service Provider warrants an identical result for any future Client.

The Website may contain links to the websites of other service providers. The Service Provider accepts no responsibility for the data protection practices or other activities of those service providers.

Users must ensure that, in using the Website and in submitting a Quote Request, they do not infringe the rights of third parties or the law, either directly or indirectly; in particular, they may not include in a Quote Request any data or content they are not entitled to disclose. Users are fully and solely responsible for their own conduct.

Liability for the Services is governed by the provisions of the Individual Contract.

7. Data protection

The Service Provider processes Users’ personal data in full compliance with data protection legislation, in accordance with its Privacy Policy.

The Service Provider processes personal data solely for the purpose of the processing, and only to the extent and for the period necessary. The Service Provider does not process special categories of data.

The Service Provider’s Privacy Policy as currently in force is available at: https://thyonesoftware.com/en/privacy/. The Website’s use of cookies is described in the Cookie Policy: https://thyonesoftware.com/en/cookies/

8. Copyright notice

The Website and its content — in particular the texts, graphic elements, images, the graphic design and the source code of the Website — are protected by copyright under the Copyright Act. The name and logo “thyone software” are the Service Provider’s designation. The screenshots in the References depict the Service Provider’s previous work and appear on the Website with the consent of the clients concerned.

No part of the content of the Website may be reproduced, distributed, communicated to the public, adapted or otherwise used without the Service Provider’s prior written permission, except for private use. In particular, the content of the Website may not be used to advertise or present the product or service of any other party.

The rights of use in works produced under the Services are governed by the Individual Contract.

9. Scope and amendment of the GTC

The Service Provider declares that the GTC are available exclusively in electronic form and are continuously accessible on the Website.

The GTC enter into force on 11 October 2026.

Users are subject to the provisions of the GTC in force at the time the Quote Request is submitted.

The Service Provider reserves the right to amend the provisions of the GTC unilaterally. An amendment enters into force on publication on the Website and applies to Quote Requests submitted after publication. The date of entry into force of the current version is stated in the GTC. An amendment does not affect Individual Contracts concluded before its entry into force.

10. Language and governing law

The GTC are available in Hungarian and in English. In the event of any discrepancy between the language versions, the Hungarian version prevails.

The GTC and the legal relationship between the Service Provider and the User are governed by Hungarian law, without depriving a Consumer resident in another Member State of the European Union of the protection afforded by the mandatory consumer protection provisions of their own Member State.

Questions concerning the GTC may be submitted via the contact details given in Section 1. Data processing is described in the Privacy Policy and cookies in the Cookie Policy.
